Finance Expert shares legal side as Tottenham exit development emerges

Tottenham could have settled on an exit fee early with Tanguy Ndombele after his contract was terminated in North London, according to Dan Plumley.

Spurs terminated the contract of Ndombele this summer despite the former France international having 12 months remaining on his deal, with Ange Postecoglou having no interest in integrating him into his first-team plans.

The football finance expert admitted that there is a legal side to decisions such as these, but adding clauses can make it much cleaner.

There’s obviously the legal side to it,” he exclusively told Tottenham News.

“There will be certain things in contracts that you have to honour, but normally when you look at player terminations of contracts if it’s for reasons where you come to a mutual agreement then there’s perhaps a negotiation there.

“What’s also happening a lot nowadays, and again we don’t see this a lot in detail, but these things are being built into contracts upfront. You’ve got exit clauses in contracts from day one. You’ve seen people in the industry and legal experts from that space suggesting that actually, that’s the most important part of any contract is the break clause and the get out. You’ve got to sort your exit out before you’re even in.

“So we know that’s happening nowadays, and it could be negotiation or it could be that it was settled way in advance. ‘If we terminate your contract here then this is the exit fee’ and etc.

“That’s smart as well because it makes it more cleaner if you do decide to terminate contracts.”

Tottenham to plan for contract terminations with new transfers?

It may seem like a very strange thing to include in a contract for a player you’re trying to bring to the club, but it may also be an incredibly smart thing to do.

There are all sorts of clauses in contracts and the reality is that a lot of them are never triggered because players are very professional and there is a way for things to go with a process.

However, there is the odd occasion where termination may be needed and having things in place already will make things much easier to deal with and to make decisions swiftly.

Getting players to agree to those terms may not be the easiest thing in the world, and the chances are that if it became a sticking point in negotiations it could be avoided or skipped, but it’s certainly something worth considering going forward.
