Man City v Premier League: Stefan Borson reacts as major update emerges

Manchester City are waiting to hear from the tribunal whether the Premier League’s approved associated party transaction (APT) rules are lawful.

That is the view of former Man City financial adviser Stefan Borson, who exclusively told Football Insider it’s unclear when the panel will provide its answers after the two parties put forward some additional questions.

The English champions took legal action against the Premier League regarding the APT rules at an arbitration hearing in June, with two aspects of the regulations deemed unlawful when the panel published its findings last month.

The Premier League issued proposed amendments earlier this month, with the top-flight clubs approving those changes at a meeting in London on Friday (22 November).

It is believed 16 sides voted in favour of the proposals, ensuring the governing body received the required two-thirds majority, as only Man City, Aston Villa, Newcastle United and Nottingham Forest rejected the motion.

In a statement, the Premier League said the changes relate to “integrating the assessment of shareholder loans” and “include the removal of some of the amendments made to APT rules earlier this year”.

But Borson insisted we still don’t know whether the changes will fix the problem.

He told Football Insider: “I think the immediate ramifications are that we at least have a set of workable rules.

“The key question is actually whether they are lawful, so that question is still outstanding.

“It really goes to the core of City’s argument, which was even if these amendments pass, we still won’t actually know whether it fixes the problem.

“We have still got to wait for the determination of the tribunal in terms of the additional questions that were put to it by both City and the Premier League.

“We don’t know when those are coming through.

“It could be any day or a few weeks.

“But essentially, City’s argument was we should wait for the tribunal.

“Aston Villa supported that argument and clearly, at the vote, that was rejected by the majority of people around the table, such that those amendments have gone in.”
