Man City v Premier League: Stefan Borson drops verdict after new development

Manchester City and the Premier League are both unlikely to challenge the verdict in their associated party transactions (APT) case.

That is the view of former Man City financial adviser Stefan Borson, who exclusively told Football Insider the Premier League’s rules only allow a challenge of an arbitration decision on limited grounds.

Man City and the Premier League clashed over the APT rules in June during a two-week hearing.

The English champions questioned the legality of the APT rules, branding them “anti-competitive” – and sued the governing body for damages.

The Athletic reported on 15 August both parties have indicated they intend to appeal against the decision if it goes against them, with a verdict expected to be delivered soon.

Man City unlikely to submit appeal in APT case

But Borson believes an appeal is unlikely to be submitted unless there have been any serious issues regarding the process of the arbitration.

He told Football Insider: “That article was about the 115 charges and it had a passing comment that they might try and appeal the arbitration.

“The Premier League rules only allow a challenge of an arbitration decision of this sort in extremely limited grounds.

“That would essentially be one of bad faith or something really quite seriously wrong with the process as well.

“It’s extremely unlikely the Premier League or City would be able to challenge any decision on that basis.

“Interestingly, the arbitration rules are very clear that you can’t challenge the decision based on how the arbitration panel has applied the law, which is the usual way in which people would challenge the arbitration up to a higher court.

“I think it’s very unlikely that there will be an appeal on the arbitration from either party.

“I think it will be one go only on that one.”
